Today the Parliament's Transport and Tourism Committee adopted a report urging the Commission to improve the legal framework and provisions governing the operation and enforcement of air passenger rights in anticipation of next year's revision of Regulation No. 261/2004.
Nathalie GRIESBECK (Modem, France), ALDE spokesperson for passenger rights, said: "The free movement within the internal market has caused a considerable increase in air traffic, and thus obliges us to revise, improve and clarify the regulations regarding passenger rights ".
Among the various improvements requested, Ms. Griesbeck was keen to stress: "We are convinced that passengers have the right to be informed about the transfer of personal data (PNR) by airlines, and the principles of proportionality and necessity. In addition, passengers should not be denied boarding because of their PNR, unless this prohibition is imposed on the carrier by the competent authorities or security services. Moreover, this decision should always be substantiated and presented in print to the passenger who is denied boarding. "
Concerning unfair trade practices, Ms. Griesbeck continued: "The Commission should ensure the full implementation and enforcement of existing laws on price transparency, that is to say that the price must align itself with the final price. Airlines should not be allowed to promote low-cost fares when all costs are not included in the fares. In addition, the Commission must clarify the legal concept of 'extraordinary circumstances', and 'cancellation' as well as the right to assistance, reparations and compensation. "
Regarding delays and loss of luggage, she concluded: "One of the main worries of every traveler is to not find his luggage on the conveyor belt after landing. Several million people each year live this misadventure. If the vast majority of luggage does finally arrive safely, hundreds of thousands never reach their destination. I propose that when a baggage delay exceeds 6 hours, compensation be provided permitting the passenger to meet his basic needs".
